What actions are required before submitting my 501(c)(3) application?

Before beginning the tax-exempt application process, you will need to:

  • Form a nonprofit entity

  • Form a board (at least one individual if you seek tax-exempt status with the IRS)

  • Adopt appropriate bylaws

  • Obtain an EIN

  • Provide a budget (showing no profit) with detail about your activities

What are the qualifications for a 501(c)(3) application?

To qualify, you must be a nonprofit that:

  • Has been organized under state law

  • Operates for a 501(c)(3) purpose such as educational, religious, scientific, medical, or other charitable causes

  • Benefits an unidentified charitable class of people

  • Engages in activities that are non-political in nature

  • Derives at least one-third of its support from the general public

I formed a nonprofit with my state. Do I automatically receive tax-exempt status?

The IRS doesn't automatically grant tax-exempt status to nonprofits. Your organization must submit a 501c3 application with the IRS to receive this status.

What are the other 501(c) entity types, and are they also tax-exempt?

There are a number of tax-exempt organizations recognized by the IRS. Not all of them allow for deductible donations, but the entity itself can benefit from tax-exempt status. Please be aware that some of the following entity types have restrictions on engaging in political activities and may be subject to more stringent disclosure requirements. Do I have to disclose expected salaries and payments to the board in my application?

Yes. The IRS may question your 501c3 application if a large percentage of revenues go to salaries and reject your application. When this is the case, your organization is acting more as a for-profit entity for the benefit of the owners or employees.

The primary benefit is that you may accept donations from donors who can then deduct the donation on their federal income tax. Also, many states accept federal 501(c)(3) status to grant sales tax or state tax exemption status. Your entity can also avoid paying federal and state taxes.
